Terms of Service & Subscription Agreement

1. About Option Strength Viewer

Option Strength Viewer (“OSV,” “Company,” “we,” “us,” or “our”) provides software tools designed to display and analyze market-related information, including options-market data, calculations, indicators, analytics, visualizations, historical information, and other market-related tools.

These Terms govern your access to and use of the OSV website, applications, software, tools, services, and related features (collectively, the “Service”).

2. Not Financial Advice

OSV is an analytical software platform and does not provide personalized investment, financial, legal, accounting, or tax advice.

OSV is not a registered investment adviser, broker-dealer, financial planner, or asset manager.

Nothing provided through OSV constitutes or should be interpreted as:

• investment advice;
• a recommendation to buy, sell, or hold a security;
• a recommendation to enter or exit an options position;
• a solicitation or offer to purchase or sell a financial instrument;
• a guarantee of future market performance; or
• a representation that any particular trading strategy will be profitable.

Terms such as “bullish,” “bearish,” “pressure,” “strength,” “score,” “signal,” “edge,” “best value,” or similar terminology describe calculations or information generated by the Service. They are not instructions or recommendations to trade.

You remain solely responsible for evaluating information presented by OSV and for all investment and trading decisions you make.

3. Trading Risk

Trading and investing involve substantial financial risk.

Options trading may involve particularly significant risks, including rapid or complete loss of capital.

Past performance, historical market behavior, statistical relationships, calculated indicators, and previous signals do not guarantee future results.

Market conditions may change rapidly, and information displayed by OSV may become outdated between the time it is obtained, processed, displayed, and acted upon.

You acknowledge that you use OSV entirely at your own risk and that you are solely responsible for your trades, investments, profits, and losses.

You should consult an appropriately licensed financial professional if you require personalized investment advice.

4. Market Data and Information

OSV may obtain market data and other information from third-party data providers, exchanges, APIs, databases, or other external sources.

Market information may be delayed, incomplete, inaccurate, temporarily unavailable, incorrectly transmitted, incorrectly processed, affected by third-party outages, or inconsistent with information displayed by another platform or data provider.

OSV does not guarantee that any market price, options-chain value, calculation, indicator, chart, signal, score, open-interest figure, volume figure, or other information will be accurate, complete, current, or uninterrupted.

You should independently verify information that is important to a trading or investment decision.

5. License and Permitted Use

Subject to these Terms and any applicable subscription requirements, OSV grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for your personal use.

Your subscription does not transfer ownership of OSV software, algorithms, calculations, designs, data-processing methods, intellectual property, or proprietary technology to you. All rights not expressly granted under these Terms are reserved.

6. Account Responsibility

You may be required to create an account to access some or all OSV features. You are responsible for maintaining the confidentiality and security of your login credentials. Your account is intended for your individual use unless OSV expressly authorizes otherwise.

You may not:

• share or resell your account;
• provide unauthorized individuals access to paid OSV features;
• circumvent subscription or access controls;
• attempt to obtain unauthorized access to OSV systems;
• scrape or systematically extract OSV content or data without authorization;
• reverse engineer proprietary OSV calculations or software where prohibited by law;
• interfere with the operation or security of the Service; or
• use OSV for unlawful purposes.

You are responsible for activity occurring through your account.

7. Subscription Service

Certain OSV features require a paid subscription. The applicable subscription price and billing interval will be displayed before you complete your purchase.

Unless otherwise specifically stated at checkout, paid subscriptions automatically renew at the applicable recurring subscription price until canceled.

By purchasing a recurring subscription, you authorize OSV and its payment processor to automatically charge your selected payment method for each renewal period until your subscription is canceled.

8. Promotional and Coupon Pricing

OSV may occasionally provide coupons, promotional offers, introductory pricing, or recurring subscription discounts. Promotions may have different terms.

First-Month Pricing: A discounted price for the first billing period, after which the subscription automatically renews at the regular monthly subscription price displayed during checkout.

Recurring Discount Pricing: A discounted monthly subscription price that continues for subsequent billing periods according to the terms displayed during checkout.

The actual price and billing terms displayed at checkout control your purchase.

You are responsible for reviewing the price, discount, renewal terms, and amount due before submitting payment.

Promotional offers may be limited, modified, discontinued, or restricted to eligible accounts at OSV's discretion, subject to applicable law. Unless otherwise stated, promotional offers have no cash value and cannot be exchanged for cash.

9. Automatic Renewal Authorization

By clicking the applicable Subscribe, Purchase, or similar checkout button and completing your purchase, you authorize OSV and its payment processor to charge your selected payment method for:

1. the amount shown as due at checkout; and
2. subsequent recurring subscription charges according to the renewal price and billing interval disclosed at checkout,

until you cancel the subscription. You are responsible for maintaining a valid payment method.

10. Cancellation

You may cancel your OSV subscription at any time through the cancellation method made available by OSV. Cancellation stops future automatic renewal charges.

Unless otherwise stated, cancellation does not immediately terminate access that has already been paid for. You may continue to have access through the end of your current paid billing period.

Canceling a subscription does not automatically provide a refund for charges already processed.

11. Refund Policy

Because OSV provides immediate access to digital software, market information, analytics, calculations, and premium features, subscription payments are generally non-refundable once paid access has been provided, except where a refund is required by applicable law.

Failure to use the Service after purchasing a subscription does not by itself create a right to a refund. Canceling your subscription prevents future renewal charges but does not ordinarily reverse a charge that has already been completed.

Nothing in this section limits any non-waivable consumer rights available under applicable law.

12. Availability of the Service

We aim to keep OSV available and operational, but uninterrupted access is not guaranteed.

The Service may occasionally be unavailable because of maintenance, software updates, infrastructure failures, market-data-provider outages, internet failures, third-party API failures, security events, technical problems, or circumstances outside our reasonable control.

We may modify, update, replace, add, remove, suspend, or discontinue features when reasonably necessary to operate, improve, secure, or maintain the Service.

13. Changes to Features and Calculations

OSV is an evolving software platform. Calculations, algorithms, interfaces, indicators, visualizations, data sources, features, and methodologies may be changed or improved over time.

A feature or calculation available when you subscribe may subsequently be modified, replaced, or discontinued. Nothing in these Terms guarantees that a particular feature, calculation, indicator, or third-party data source will remain unchanged indefinitely.

14. Intellectual Property

OSV and its original software, designs, branding, interfaces, calculations, visualizations, documentation, content, and other proprietary materials are owned by Option Strength Viewer or its applicable licensors and are protected by applicable intellectual-property laws.

“OSV,” “Option Strength Viewer,” associated logos, and related branding may not be used without authorization.

You may not reproduce, distribute, resell, commercially exploit, or create unauthorized derivative works from protected OSV materials except where permitted by applicable law or expressly authorized by OSV.

15. Third-Party Services

OSV may depend upon or integrate with third-party services, including market-data providers, payment processors, hosting providers, authentication providers, and other technology platforms.

Those third parties operate independently and may be subject to their own terms and privacy policies. OSV is not responsible for outages, errors, policy changes, data inaccuracies, or other failures caused by third-party services beyond OSV's reasonable control.

16. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OSV IS PROVIDED “AS IS” AND “AS AVAILABLE.”

OSV DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AVAILABILITY, TITLE, AND NON-INFRINGEMENT.

We do not warrant that OSV will always be available, will be error-free, that market data will always be accurate or current, that calculations will always produce a particular result, that signals or indicators will predict future market movements, or that use of OSV will result in profitable trading.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OPTION STRENGTH VIEWER AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AGENTS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF OSV.

This includes, without limitation, losses arising from securities or options trading, investment decisions, lost profits, lost opportunities, inaccurate or delayed market information, software errors, interruptions or outages, or reliance upon information displayed by OSV.

You acknowledge that OSV does not execute trades on your behalf and that all trading decisions remain under your control. Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.

18. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Option Strength Viewer and its owners, officers, employees, contractors, affiliates, agents, licensors, and service providers from claims, damages, liabilities, losses, and reasonable expenses arising from your misuse of the Service, your violation of these Terms, your violation of applicable law, or your infringement of another person's rights.

19. Suspension or Termination

OSV may suspend or terminate access to the Service when reasonably necessary because of violation of these Terms, fraudulent activity, unauthorized account sharing, attempted circumvention of access or payment controls, abuse of the Service, security threats, or unlawful activity.

Termination or suspension does not eliminate payment obligations that arose before termination.

20. Changes to These Terms

We may update these Terms periodically. When material changes are made, we may provide notice through the Service, website, email, or another reasonable method.

The updated Terms will identify their effective or last-updated date. Where applicable law requires additional consent to a material change, we will obtain that consent.

21. Governing Law

These Terms shall be governed by and interpreted according to the laws of the State of California, without regard to its conflict-of-law principles, except where applicable consumer-protection laws require otherwise.

22. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the maximum extent permitted by law.

23. Entire Agreement

These Terms, together with any policies or disclosures expressly incorporated into them and the pricing and subscription terms presented at checkout, constitute the agreement between you and Option Strength Viewer regarding your use and purchase of the Service.
